If you own, manage or operate a business, you need to comply with fire safety law. The main law is the Regulatory Reform (Fire Safety) Order 2005 or “the Fire Safety Order”. It applies across England and Wales and came into force on 1 October 2006. 

Fire and rescue authorities and other enforcing bodies have a duty to enforce fire safety in non-domestic premises. 

The Regulatory Reform (Fire Safety) Order 2005 places a duty on the responsible person to: 

“make a suitable and sufficient assessment of the risks to which the relevant persons are exposed for the purpose of identifying the general fire precautions he needs to take to comply with the requirements and prohibitions imposed upon him by the order”. 

Under the latest Fire Safety order 2005 regulations there are 5 key elements:

  • Decide who is the Responsible Person.
  • Carry out a Fire Risk Assessment.
  • Implement Fire Safety and Evacuation plans – ensure all those involved are trained and informed.
  • Ensure Adequate Fire Safety Equipment, ensure it is maintained.
  • Be aware of Enforcement, appeals and penalties relating to Fire Safety.
